Who Needs Asset Protection? Everyone.

When most people hear the term asset protection, they assume it’s only for the ultra-wealthy or those with sprawling estates. But the truth is far more inclusive: everyone needs some form of asset protection, from young professionals just starting out to retirees looking to preserve a lifetime of savings. If you have any assets, you need to protect them.

What Is Asset Protection?

Asset protection is the strategic use of legal tools and financial planning to safeguard your wealth from potential threats. These threats can include

  • Lawsuits
  • Creditors
  • Divorce
  • Business liabilities
  • Unexpected medical expenses
  • Economic downturns

The goal is simple: keep what you’ve earned, no matter what life throws your way.

Why You Need It

You don’t need to be a millionaire to be at risk. If you own a home, have a savings account, run a business, or even just drive a car, you’re exposed to potential liability. Asset protection isn’t about hiding wealth—it’s about planning ahead to ensure your assets are legally shielded before a problem arises.

The Asset Protection Continuum in Nevada

Nevada is one of the most favorable states in the country for asset protection. There are many tools in the toolbox. In most cases, we advise you to use all of the tools that are available to you. However, we never want you to spend money on things that don’t benefit you. Here’s a look at some of the tools available, from basic to advanced:

1. Insurance

The first line of defense. Homeowners, auto, umbrella, and professional liability insurance are essential. They provide coverage for common risks and are relatively inexpensive.

Although auto insurance in Nevada is becoming more expensive, your ability to obtain affordable umbrella insurance may help to shield your assets.

2. Homestead Exemption

Nevada offers a generous homestead exemption—up to $605,000 in equity in your primary residence is protected from general creditors. Filing a homestead declaration is simple and cost-effective. The recordation fee is only $42.00. If you own a home, this is the easiest and most cost-effective protection available.

3. Limited Liability Companies (LLCs)

If you own rental properties or operate a business, an LLC can separate your personal assets from business liabilities. Nevada LLCs are particularly strong due to favorable charging order protections, which limit a creditor’s ability to seize company assets. Forming an LLC may not be enough, though; you need to operate it properly to shield assets from liability.

4. Nevada Asset Protection Trust (NAPT)

This is the gold standard. A NAPT is an irrevocable trust that allows you to protect assets from future creditors while still retaining some control and benefit. Nevada’s laws are among the most protective in the nation. Although there are greater costs and administrative responsibilities with a NAPT, the protections from one are absolute.

Asset Protection Is for Everyone

Whether you’re a teacher, a doctor, a small business owner, or a retiree, you have something worth protecting. The good news is that asset protection isn’t one-size-fits-all. There are tools at every level and price point, and a well-designed plan can be tailored to your unique needs and goals.
